Product Liability
Organizations like the National Institute for Occupational Safety and Health (NIOSH), the Federal agency responsible for conducting research and making recommendations for the prevention of work-related disease and injury and Occupational Safety and Health Administration (OSHA), whose mission is to ensure safe and healthful workplaces in America, have worked to cut workplace fatalities in half and reduce occupational injury and illness rates by 40 percent since 1971.
Manufactures are also required to produce reasonably safe products. The U.S. Consumer Products Safety Commission (CPSC), an independent Federal regulatory agency, helps keep American families safe by reducing the risk of injury or death from consumer products. According to the CPSC’s 1999 Annual Report, injuries kill more children than any disease in the U.S., and account for a sixth of all hospital stays. The report also reveals that there is an average of 22,000 deaths and more than 29 million injuries each year related to consumer products. In 1999, the CPSC worked with industry to obtain more than 300 corrective actions involving about 75 million consumer product units. About 95 of these actions were toys and children's products, involving more than 60 million product units.
When these duties to provide safe work environments and safe products are breached, corporations must compensate their victims. Product liability cases are often complex and require ingenuity and substantial resources. The outcome of these cases often relies on the expert witness’ testimony. We have the resources to secure experts, one of the most difficult and time-consuming tasks in preparing a product liability case.
As with all personal injury cases, within the first week, important physical evidence can be lost, witnesses may be difficult to locate or even forget important details. To protect the legal rights of someone who has been injured by a product, it is important to consult an experienced personal injury law firm as quickly as possible.
